Terms of Service

Welcome to Fishgram. These Terms of Service ("Terms") govern your access to and use of the Fishgram website, web application, and related services (collectively, the "Service"). The Service is operated by Shulure Ventures LLC (doing business as Fishgram), a Texas limited liability company ("Shulure Ventures LLC," "Fishgram," "we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms.

If you do not agree to these Terms, do not use the Service.

Important notice about measurement accuracy. Fishgram produces AI-generated estimates of fish length. These estimates can be inaccurate and must not be relied upon for any regulatory, legal, or compliance purpose, including but not limited to determining compliance with fishing regulations, keeper limits, slot limits, tournament rules, or any law enforcement context. Always use a physical measuring device when accuracy matters.

1. Acceptance of Terms

By visiting https://fishgram.com, uploading a photo, or otherwise using the Service, you agree to these Terms and to our handling of your data as described in our Privacy Policy. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Eligibility

You must be at least 13 years old to use the Service, or 16 years old if you are located in a jurisdiction where 16 is the minimum age for consent to data processing (including much of the European Economic Area and the United Kingdom). By using the Service, you represent and warrant that you meet the applicable age requirement. If we learn that we have collected data from a user below the applicable minimum age, we will delete that data.

3. Description of the Service

Fishgram is a free consumer web application that estimates the length of a fish from a photograph. The Service uses a combination of AI-powered computer vision techniques, including depth estimation, fish detection, and reference-object analysis, to produce an estimated length in inches. You may also optionally submit feedback on a measurement, such as a thumbs-up or thumbs-down rating, the actual length you measured, and the fish species.

The Service is provided free of charge today. We reserve the right to introduce paid features, subscriptions, or other monetization in the future. If we do, we will update these Terms and, where appropriate, give you notice before any paid feature affects you.

4. Anonymous Usage; No Accounts

The Service does not currently require you to create an account, register, or submit any personally identifying information. To operate the Service and associate your uploads and feedback with your session, we assign you an anonymous cookie-based identifier. This identifier lets us track measurement history, prevent abuse, and improve the Service. You can clear this identifier at any time by clearing cookies in your browser, though doing so will detach any prior measurements from your future sessions.

5. User Content and License Grant

Your content. Any images, feedback, species identifications, measurements, or other material you submit to the Service is referred to as "User Content." You retain ownership of your User Content.

License to Fishgram. By submitting User Content, you grant Shulure Ventures LLC a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, copy, reproduce, process, analyze, transmit, display, and create derivative works from that User Content, solely for the purposes of:

  • Operating, providing, and maintaining the Service, including running AI inference on your images
  • Transmitting your User Content to third-party service providers as needed to deliver results
  • Improving, training, evaluating, and debugging the Service and our measurement algorithms
  • Generating aggregated or de-identified statistics
  • Displaying your measurement and feedback back to you within the Service

Your representations. By submitting User Content, you represent and warrant that (a) you own or have all necessary rights to the User Content and to grant this license; (b) your submission does not violate any law or the rights of any third party, including privacy, publicity, intellectual property, or contractual rights; and (c) the User Content does not contain any material prohibited under Section 6.

6. Acceptable Use

You agree not to use the Service to:

  • Upload or transmit any content that is illegal, infringing, defamatory, harassing, hateful, or violates the rights of others
  • Upload child sexual abuse material (CSAM) or any content depicting the sexual exploitation of minors. Any such upload will be reported to the National Center for Missing & Exploited Children (NCMEC) and to law enforcement as required by law
  • Upload images depicting non-consensual nudity, real-world violence, or other content that violates applicable law
  • Reverse engineer, decompile, disassemble, or otherwise attempt to derive source code or underlying algorithms of the Service
  • Scrape, crawl, or use automated means to access the Service or extract data from it, except through interfaces we have expressly provided for that purpose
  • Circumvent, disable, or interfere with security, rate-limiting, authentication, or access-control features of the Service
  • Impose an unreasonable load on our infrastructure, including by submitting large volumes of requests or submitting inputs designed to exhaust resources
  • Use the Service to build or train a competing product or service
  • Impersonate any person or entity or misrepresent your affiliation with any person or entity
  • Use the Service in violation of any applicable law or regulation

We may investigate, remove, or block any User Content or user that we reasonably believe violates these Terms.

7. Accuracy Disclaimer

The measurements produced by the Service are AI-generated estimates based on imperfect inputs (your photograph, depth estimates, and reference objects) and imperfect models. They may be materially inaccurate. You agree not to rely on Fishgram measurements for any regulatory, legal, commercial, tournament, or compliance purpose, including, without limitation, determining compliance with any fishing regulation, size limit, slot limit, bag limit, or tournament rule. If an accurate measurement matters, use a physical ruler, bump board, or other calibrated instrument.

8. Intellectual Property

Shulure Ventures LLC owns all right, title, and interest in and to the Service, including the website, the underlying code, the measurement algorithms, the user interface, the "Fishgram" name, the logos, and all related branding. Except for the limited rights expressly granted to you in these Terms, nothing in these Terms transfers any intellectual property rights to you. All rights not expressly granted are reserved.

You retain ownership of your User Content, subject to the license granted in Section 5.

9. Third-Party Services

The Service relies on third-party infrastructure and AI providers to operate, including hosting, cloud storage, databases, and AI model inference. By using the Service, you acknowledge that your User Content and associated metadata may be transmitted to and processed by those providers. Each has its own terms and privacy practices. We do not control their systems, and we are not responsible for the acts or omissions of third-party providers beyond the commitments we make in our Privacy Policy.

10. Termination

We may suspend, restrict, or terminate your access to the Service at any time, with or without notice, for any reason, including if we believe you have violated these Terms. You may stop using the Service at any time by discontinuing use and, if you wish, clearing your browser cookies. Sections that by their nature should survive termination (including Sections 5, 7, 8, 11, 12, 13, 15, and 16) will survive.

11. Disclaimers

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. To the fullest extent permitted by law, Shulure Ventures LLC disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, and any warranties arising out of course of dealing or usage of trade.

Without limiting the foregoing, we make no warranty that (a) the Service will meet your requirements; (b) the Service will be uninterrupted, timely, secure, or error-free; (c) any results obtained from the Service, including any measurement, will be accurate or reliable; or (d) any errors in the Service will be corrected.

12. Limitation of Liability

To the fullest extent permitted by law, Shulure Ventures LLC and its officers, employees, contractors, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or other intangible losses, arising out of or related to your use of or inability to use the Service, even if we have been advised of the possibility of such damages.

To the fullest extent permitted by law, our aggregate liability for any and all claims relating to the Service is limited to the greater of (a) the amount you have paid us in the twelve (12) months preceding the event giving rise to the claim, or (b) US $100. Because the Service is currently provided free of charge, this cap will typically be US $100.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

13. Indemnification

You agree to defend, indemnify, and hold harmless Shulure Ventures LLC and its officers, members, employees, contractors, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Service; (b) your User Content; (c) your violation of these Terms; or (d) your violation of any law or the rights of any third party.

14. Changes to the Terms

We may update these Terms from time to time. When we do, we will update the "Last updated" date at the top of this page and, for material changes, provide additional notice where reasonable. Your continued use of the Service after the updated Terms take effect constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, stop using the Service.

15. Governing Law; Arbitration; Class-Action Waiver

Governing law and venue. These Terms and any dispute arising out of or related to them or the Service are governed by the laws of the State of Texas, USA, without regard to its conflict-of-laws rules. Subject to the arbitration provisions below, any action not subject to arbitration must be brought exclusively in the state or federal courts located in Travis County, Texas, and you consent to the personal jurisdiction of those courts.

Binding arbitration. You and Shulure Ventures LLC agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Service will be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court, except that (a) you may assert claims in small-claims court if your claims qualify, and (b) either party may seek injunctive or equitable relief in court to protect intellectual property rights. The arbitration will take place in Travis County, Texas, or, at your election, remotely.

Class-action waiver. You and Shulure Ventures LLC each waive the right to participate in a class action, class arbitration, collective action, or representative action. Claims must be brought in an individual capacity only. If a court or arbitrator finds this class-action waiver unenforceable as to a particular claim, that claim (and only that claim) must be severed and brought in court, while all remaining claims proceed in arbitration.

30-day opt-out. You may opt out of the arbitration and class-waiver provisions in this Section 15 by sending written notice to legal 'at' fishgram.com within thirty (30) days of first accepting these Terms. Opting out will not affect any other part of these Terms.
